Website Subscription Terms

By subscribing to Brakebee's Website Service ("Website Service," "Service"), you agree to the following terms and conditions. These terms supplement the Brakebee Terms of Use and apply specifically to artist websites hosted through our platform.

1. Service Description

  • The Website Service provides tools for creating, hosting, and managing your own artist website using the features available in your chosen plan.
  • Sites may include pre-built integrations with the Brakebee platform, including product syncing, centralized cart functionality, automatic updates from your artist profile, and dashboard management tools.
  • Feature availability varies by subscription plan and may be updated or expanded over time.

2. Subscription Fees & Billing

  • Your subscription is billed monthly at the rate listed for your selected plan unless otherwise stated.
  • Additional add-ons, upgrades, or usage-based services may incur separate charges, which will be clearly displayed before purchase.
  • All charges are billed to the payment method on file. Failed payments may result in suspension or downtime of your hosted website(s).
  • Subscription fees are non-refundable once a billing cycle begins.

3. Content Ownership & Responsibility

  • You retain ownership of all content you upload to your website, including images, text, listings, branding assets, and media.
  • You are solely responsible for ensuring that your content complies with Brakebee's Acceptable Use Policy, intellectual property rules, and applicable laws.
  • You agree not to upload harmful, illegal, or infringing content, and you assume full liability for any content you publish.

4. Domain Names

  • You may connect a custom domain to your website at any time. Domain configuration requires DNS verification.
  • Brakebee does not manage domain registration, transfer, renewal, or expiration. These remain your responsibility.
  • If your domain lapses, becomes misconfigured, or is suspended by your registrar, your website may become inaccessible until resolved.

5. Service Availability & Performance

  • Brakebee targets 99.9% uptime but does not guarantee uninterrupted or error-free service.
  • Planned maintenance, platform upgrades, carrier network issues, or external outages may temporarily affect site availability.
  • Brakebee is not liable for downtime or data loss resulting from factors outside our control, including user misconfiguration, third-party domain services, or hosting infrastructure partners.

6. Cancellation & Termination

  • You may cancel your website subscription at any time through your dashboard.
  • Your website will remain active until the end of the current billing period; no prorated refunds are provided.
  • Brakebee may suspend or terminate your subscription for violations of these terms, the Acceptable Use Policy, or failure to maintain a valid payment method.

7. Data Retention & Export

  • After cancellation, your website data (including pages, media, design, and settings) will be retained for 30 days.
  • After 30 days, all associated website data may be permanently deleted and cannot be recovered.
  • You are responsible for exporting or backing up your data before the retention period ends.

8. Platform Updates & Feature Changes

  • Brakebee may introduce new features, modify existing ones, or discontinue elements of the Website Service at any time.
  • Material changes will be communicated in advance whenever reasonably possible.
  • Continued use of the Service after such changes constitutes acceptance of the updated terms or feature set.

9. User Responsibilities

By using the Website Service, you agree to:

  • Maintain accurate account information and billing details.
  • Comply with all Brakebee policies applicable to hosted websites.
  • Ensure that your website does not harm platform infrastructure or violate relevant laws.
  • Maintain control of connected domain settings and security.

10. Acceptance of Terms

By proceeding with your subscription, activating your website, or continuing to use the Service, you acknowledge that you have read, understood, and agree to be bound by these Website Subscription Terms.
