Copyright Policy

COPYRIGHT POLICY FOR BRAKEBEE.COM Last Updated: July 2, 2025 At Brakebee LLC (OAF, "we," "us," or "our"), we value the creativity and intellectual property of artists who share their work on Brakebee.com ("the Site"). This Copyright Policy explains how we handle the rights to content you upload, our protections for that content, and how we address copyright complaints. It's written to be clear and straightforward, so you know exactly what to expect. 1. YOUR CONTENT AND OUR LICENSE TO USE IT When you upload artwork, images, or other content ("User Content") to the Site, you keep ownership of your original copyright. However, to operate the Site and promote your work, you grant Brakebee a broad license to use your User Content. Here's what that means: • What We Can Do: You give us a worldwide, non-exclusive, royalty-free, perpetual, and transferable license to use, display, reproduce, distribute, modify (e.g., resize images for the Site), and publish your User Content in any format or medium. This includes using your content for: - Displaying on the Site. - Promoting the Site or your work through social media, email, print media, advertisements, or other marketing. - Creating derivative works, like thumbnails or promotional banners. - Any other use related to operating or improving the Site. • What We Can't Do: We cannot reproduce your User Content for commercial sales (e.g., selling prints or merchandise featuring your artwork) without your explicit permission. If you choose to allow us to sell your work on your behalf, that will be covered by separate terms. • Why This Matters: This license lets us showcase your art to a global audience while ensuring we don't overstep by selling your work without your consent. In legal terms: You grant Brakebee a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Site and Brakebee's business, including for marketing and promotion, in any media formats and through any media channels, except for commercial reproduction or sales without your express written consent. 2. OUR RIGHT TO PROTECT YOUR CONTENT If someone steals your User Content from our Site (e.g., by downloading and using your artwork without permission), Brakebee has the authority to take legal action against them as if we were the copyright owner. This helps us protect your work and maintain the integrity of the Site. For example, if a painter uploads an image of their painting, we can't sell prints of it without their permission. But if someone right-clicks and downloads that image for unauthorized use, we can pursue legal remedies, including seeking damages, on your behalf. This doesn't mean we own your copyright—it means we have the power to act to protect your work. In legal terms: By uploading User Content, you assign Brakebee the right to enforce the copyright against unauthorized use by third parties, including the right to pursue legal action and recover damages, while you retain ownership of the underlying copyright. 3. YOUR RESPONSIBILITIES When you upload User Content, you confirm that: • You own the copyright or have permission to upload it. • Your content doesn't infringe on anyone else's rights (e.g., copyrights, trademarks, or privacy). • You're okay with us using your content as described in this policy. If your content violates someone else's rights, you're responsible for any resulting issues. We may remove or disable access to content that we believe violates this policy or applicable laws. 4. COPYRIGHT COMPLAINTS If you believe someone on our Site is using your copyrighted work without permission, you can submit a complaint. We follow standard procedures to review and address these issues, including removing infringing content when required by law. To file a copyright complaint, please contact us at legal@brakebee.com with the following details: • A description of the copyrighted work you claim has been infringed. • The location on our Site where the infringing material appears (URL or specific page). • Your contact information (name, address, email, phone number). • A statement that you have a good faith belief that the use is unauthorized. • A statement that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf. • Your physical or electronic signature. We'll review your complaint and take appropriate action, which may include removing the content or disabling access to it. 5. CHANGES TO THIS POLICY We may update this Copyright Policy from time to time to reflect changes in our practices or legal requirements. If we make significant changes, we'll notify you through the Site or by email. The updated policy will apply to all User Content uploaded after the change, and to previously uploaded content where permitted by law.
