Marketplace Terms

By joining, selling on, or purchasing through the Brakebee Marketplace ("Marketplace"), you agree to the following terms. These terms apply to all users, including both Sellers (Artists) and Buyers.

SECTION 1 — SELLER TERMS (ARTISTS / VENDORS)

1. Handmade & Authenticity Requirements

Sellers agree that:

  • All products listed are handmade, artist-designed, or artisan-crafted by the Seller or under their direct creative supervision.
  • No mass-produced, drop-shipped, or misrepresented goods may be listed.
  • Sellers will provide accurate documentation of process and materials when requested.
  • Brakebee may remove any item that does not meet marketplace standards.

2. Product Listings & Accuracy

Sellers must:

  • Provide truthful, complete, and current listings, pricing, photos, and specifications.
  • Maintain accurate stock levels and lead times.
  • Disclose materials, variations, or made-to-order timelines clearly.
  • Not use misleading descriptions or imagery.

Brakebee may edit, recategorize, or reject listings to maintain marketplace quality and cohesion.

3. Jury Review & Curation

  • All listings may be reviewed by Brakebee's jury team.
  • Jury decisions (approval, rejection, request for revisions) are final.
  • Brakebee may curate, feature, re-categorize, or decline items at its discretion.

4. Seller Conduct

Sellers must:

  • Maintain professional communication with buyers and support.
  • Respond to messages and order issues promptly.
  • Follow all platform policies and community standards.

5. Commissions, Fees & Payment

  • Brakebee charges a 15% commission on completed sales.
  • Additional service fees may apply (label purchases, upgrades, add-ons).
  • Sellers must maintain a valid payment and payout method.
  • Brakebee may deduct commissions, fees, adjustments, or chargebacks from payouts or charge the on-file payment method.
  • Payouts may be withheld temporarily for fraud review or dispute resolution.

6. Order Fulfillment

Sellers agree to:

  • Ship orders within their stated handling time.
  • Package items securely and professionally.
  • Provide accurate weights/dimensions for shipping if using Brakebee's shipping tools.
  • Provide tracking when required.
  • Notify Brakebee quickly regarding delays or production issues.

Repeated fulfillment failures may result in account removal.

7. Returns, Refunds & Disputes

Sellers must adhere to:

  • The Brakebee Marketplace Guarantee for damaged, defective, or mis-shipped items.
  • Their own published return policies when applicable.
  • Providing replacements or refunds when required.

Brakebee may intervene and issue refunds on the seller's behalf if the seller is unresponsive or in violation of policies.

8. Intellectual Property

Sellers confirm that:

  • They own or have rights to all content they upload.
  • They grant Brakebee a license to display and promote their content through the Marketplace.
  • They will not upload infringing or unauthorized materials.

9. Compliance & Legal Requirements

Sellers must comply with:

  • All applicable laws, regulations, labeling rules, taxes, and safety standards.
  • All platform rules and community standards.

10. Account Suspension

Marketplace participation may be revoked for:

  • Policy violations
  • Fraudulent activity
  • Customer complaints
  • Unsafe products
  • Low-quality or misrepresented work
  • Non-responsiveness to support inquiries

SECTION 2 — BUYER TERMS

1. Marketplace Role

Buyers understand that:

  • Brakebee is a marketplace connecting buyers with independent artists.
  • Most items are fulfilled directly by Sellers.
  • Brakebee is not the seller of record except where explicitly stated.

2. Product Expectations

  • Handmade items may include natural variations.
  • Colors, finishes, and small differences may occur due to artistic processes.
  • Product descriptions and photos are provided by the Seller and intended to be accurate.
  • If authenticity concerns arise, Brakebee may step in at its discretion.

3. Ordering & Payments

Buyers agree to:

  • Provide accurate billing, shipping, and contact information.
  • Pay for orders using valid payment methods.
  • Understand that orders may be canceled due to errors, suspected fraud, or seller unavailability.

Payment processing is handled through trusted third-party services.

4. Shipping & Delivery

  • Shipping timelines depend on each Seller's handling time.
  • Delivery estimates are based on carrier performance and may vary.
  • Tracking is provided when available.
  • International orders may incur additional duties, taxes, or import fees.

5. Returns, Refunds & Marketplace Guarantee

Buyers agree to:

  • Follow the Marketplace Return Policy.
  • Report damaged, defective, or mis-shipped items promptly with required documentation.
  • Understand that voluntary returns depend on each Seller's published policy.

Brakebee may resolve disputes between buyers and sellers; decisions may be final.

6. Buyer Conduct

Buyers must:

  • Communicate respectfully with artists and support staff.
  • Avoid harassment, abuse, or unreasonable demands.
  • Not misuse review systems or return policies.

7. Prohibited Buyer Actions

Buyers may not:

  • Attempt off-platform purchases with Sellers.
  • Abuse refunds or initiate chargebacks without attempting platform resolution.
  • Reproduce or commercially exploit artwork without permission.
  • Purchase with intent to copy or reverse-engineer creative work.

Violations may result in account restrictions or permanent removal.

8. Compliance

Buyers are responsible for:

  • Complying with applicable import, tax, and consumer laws.
  • Ensuring purchased products can legally be shipped or used in their jurisdiction.

9. Account Suspension

Brakebee may suspend buyers who:

  • Engage in fraud
  • Harass Sellers
  • Violate payment rules
  • Abuse policies
  • Repeatedly cause disputes

SECTION 3 — GENERAL TERMS FOR ALL PARTICIPANTS

1. Marketplace Curation Rights

Brakebee may:

  • Approve or decline listings
  • Feature or promote specific products
  • Adjust categories and search placement
  • Modify marketplace structure or features

Participation does not guarantee visibility, ranking, or sales.

2. Policy Updates

These Marketplace Terms may be updated periodically. Continued use of the Marketplace constitutes acceptance of updated terms.

Acceptance of Terms

By using the Brakebee Marketplace—whether as a Buyer or Seller—you confirm that you have read, understand, and agree to these Marketplace Terms.
